2. Acceptance
By using this website, requesting an enquiry, or purchasing or renting a vehicle from us, you agree to these Terms & Conditions. If you do not agree, please do not use the website or our services.
3. Vehicle listings
Photographs and descriptions of vehicles on the website are provided in good faith and are believed to be accurate at the time of publication. However:
- Listings are not a binding offer. A binding contract is formed only when you sign a sale or rental agreement with us.
- Stock changes daily. A vehicle may be reserved or sold by the time you contact us.
- Where there is a discrepancy between the listing and the vehicle as inspected, the inspected vehicle prevails.
- Mileage, accident history, and previous owners are reported based on documents provided to us, which we verify against the official Spanish DGT vehicle history (informe de la DGT) where applicable.
4. Reservations
You may reserve a vehicle by paying a deposit (typically €500 to €1,000). Reservations are subject to:
- The deposit is fully refundable within 14 days if you choose not to proceed and the vehicle has not yet been transferred to your name.
- The deposit is forfeited if you withdraw after a sale contract has been signed and we have begun the registration process.
- If we are unable to deliver the vehicle for any reason within our control, we will refund the deposit in full, plus any documented direct expenses you can demonstrate.
5. Sale of vehicles
- All vehicles are sold with a fresh ITV (Spanish technical inspection) valid at the time of handover.
- Each vehicle comes with a 1-year mechanical warranty covering the powertrain (engine, gearbox, drivetrain). Wear-and-tear items are excluded. Full warranty terms are provided with your sale contract.
- Title is transferred to you only after full payment has cleared. Until then the vehicle remains our property.
- Risk in the vehicle passes to you upon delivery and signature of the handover document.
- Used-vehicle sales between a business (us) and a consumer (you) are subject to the consumer-protection guarantees of Spanish Royal Legislative Decree 1/2007, including a minimum 1-year legal warranty for non-conformity, in addition to our commercial warranty.
6. Right of withdrawal
The Spanish consumer-rights law generally grants a 14-day right of withdrawal for distance contracts. However, this right does not apply to vehicle sales where the vehicle has been registered in your name with the DGT, because the goods become "personalised" through registration (Art. 103(c), Royal Legislative Decree 1/2007).
If you change your mind before your vehicle is registered to you, you may withdraw under the standard 14-day rule. After registration, any return is by mutual agreement only and may involve administrative costs.
7. Rentals
For vehicle rentals, the following additional rules apply:
- Drivers must be at least 21 years old, with a valid driving licence held for at least 2 years and a valid passport or NIE.
- A security deposit is held on a credit card (not cash) for the duration of the rental.
- The vehicle must be returned in the same condition received, with the agreed fuel level. Damage and missing items are deducted from the deposit.
- Cross-border travel and off-road use are not permitted unless explicitly authorised in writing.
- Late return is charged per the daily rate, plus a 25% premium per started day.
- The renter is liable for fines, tolls, and any traffic penalties incurred during the rental period, plus a €50 administrative fee per incident.
8. Pricing and payment
- All prices include Spanish IVA (VAT) where applicable. The IVA rate and amount are itemised on every invoice.
- We accept bank transfer, debit and credit cards (Visa, Mastercard), and certified cheques. Cash is accepted only up to the legal limit (currently €1,000 for resident customers and €10,000 for non-resident customers under Spanish anti-money-laundering law).
- For amounts over €10,000 we are obliged to report the transaction to SEPBLAC and to verify your identity per Law 10/2010.
9. Liability
Our total liability for any claim arising from a vehicle sale or rental is limited to the amount you paid us under that contract. We are not liable for indirect or consequential losses (loss of earnings, alternative travel costs beyond statutory minima, etc.) except in cases of gross negligence or wilful misconduct, which cannot be excluded under Spanish law.
Nothing in these terms limits your statutory rights as a consumer under Spanish or EU law.
10. Use of the website
You may use this website for lawful purposes only. You may not:
- Use automated tools (scrapers, bots) to extract listings or other content.
- Attempt to gain unauthorised access to the site or our systems.
- Interfere with site availability or other users' use.
- Submit false information through enquiry forms.
All site content (text, photographs, layout, code) is owned by Drive & Deal Autos, S.L or licensed to us, and is protected by Spanish and EU copyright law.
11. Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute arising from a contract with us is subject to the exclusive jurisdiction of the courts of Málaga, Spain — except where consumer-protection law gives you the right to bring an action in your place of residence within the EU.

12. Changes
We may update these Terms & Conditions from time to time. The version in force at the moment you sign a sale or rental contract is the version that governs that contract. Changes to website-use terms take effect on publication.
